What does the time tracking law require?

Since May 2019, all companies in Spain must record the working hours of every employee (art. 34.9 of the Workers' Statute, RDL 8/2019). It doesn't matter the size, the industry or whether your team works onsite or remotely.

Daily clock-in and clock-out

Each worker must have the exact start and end time documented for every working day. It is the company's responsibility to ensure this.

Retention for 4 years

Records must be kept for at least four years and be available to workers, their legal representatives and the Labour Inspectorate.

Available for inspection

Upon request, the company must present records immediately. A digital system with PDF or CSV export greatly facilitates this process.

Applies to all companies

There are no exceptions. Whether your company has 1 employee or 500, operates in hospitality or tech. Time tracking is mandatory.

The digital reform (pending)

The Government has approved the processing of a decree-law that will strengthen time tracking requirements: mandatory digital clocking with individual credentials, automatic time stamping, no deletion without traceability, immutable records with correction history and remote access for the Labour Inspectorate. Companies that adopt a digital system early will be better prepared when it comes into force.

Penalties

What happens if you don't comply with time tracking?

Not having a time tracking system or using it incorrectly is considered a serious infraction under the Law on Infractions and Sanctions in the Social Order (LISOS).

Current penalties

Minimum grade €751 — €1,500
Medium grade €1,501 — €3,750
Maximum grade €3,751 — €7,500

With the new reform, the risk multiplies

Penalties will be calculated per affected worker. A company with 50 employees without time tracking could face penalties of up to €375,000.

Other consequences

In overtime labour disputes, the burden of proof falls on the company: without records, the judge will presume the hours claimed by the worker are true. Inspection campaigns on time tracking are increasingly frequent.

Frequently asked questions about time tracking

Is time tracking mandatory for all companies?

Yes, for all of them. No exceptions for size or industry. It has been mandatory since May 2019 (art. 34.9 of the Workers' Statute).

What if the Labour Inspectorate visits my company?

Is paper-based time tracking still valid?
